These Terms & Conditions, their subject matter, and their formation are governed by and construed in accordance with the laws of England and Wales. You and artwhich® (Art Which Ltd) agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or your use of our website and services.

 

2. No Guarantee of Results (Disclaimer of Outcome)

• Educational & Advisory Purpose Only: All consulting, advisory, training, workshops, and coaching services (including 1:1 sessions, admissions guidance, executive coaching, and organizational strategy) are designed strictly to provide framework guidance, strategic advice, and skills development.

• No Promised Outcomes: artwhich® does not guarantee specific, quantifiable, or ultimate results. This includes, but is not limited to: university or program admissions, job offers, revenue targets, investment funding, or specific professional or regulatory accreditations.

• Client Responsibility: Organizational and individual performance depends on external variables beyond our control, including client commitment, market conditions, third-party decisions, and individual execution.

 

3. Standard of Service (Consumer Rights Act 2015)

In accordance with the Consumer Rights Act 2015, artwhich® warrants that all services will be delivered with reasonable care and skill by appropriately qualified personnel. Nothing in these Terms excludes or restricts any statutory rights you hold as a consumer under English law.

 

4. Limitation of Liability & Professional Indemnity

• Business & Consequential Loss: To the fullest extent permitted by law in England and Wales, artwhich® shall not be liable for any indirect, special, consequential, or economic losses, including loss of profit, loss of business opportunity, reputation damage, or loss of data.

• Total Liability Cap: Save for express terms agreed within an individually executed Statement of Work (SOW) or Consultancy Agreement, our total aggregate liability arising out of or in connection with any service shall be strictly limited to the total fees paid by you to artwhich® for the specific service giving rise to the claim.

• Non-Excludable Liability: Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be lawfully excluded or limited under the laws of England and Wales.

 

5. Booking, Fees & Cancellations

• Payment Terms: Service fees must be paid in full prior to the delivery of services unless an alternative schedule is agreed upon in writing or set out within a signed client contract.

• Statutory Cooling-Off Period: If you are a consumer purchasing services online or at a distance, you have a statutory right to cancel within 14 days of purchase under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. If you explicitly request services to commence immediately during this 14-day period, you acknowledge that you waive your right to cancel once services are fully performed, or agree to pay for services delivered up to the cancellation date.

• Individual Engagement Contracts: Where an individual agreement, Statement of Work (SOW), or consultancy contract is executed between you and artwhich®, any specific payment, rescheduling, or cancellation terms detailed in that contract shall govern the engagement.

 

6. Priority of Documents (Order of Precedence)

In the event of any conflict, ambiguity, or inconsistency between these website Terms & Conditions and the terms of an individually executed contract, proposal, or Statement of Work signed by both parties, the terms of the individually signed contract shall take precedence to the extent of that inconsistency.
